RestrictionsYou may not copy, modify, distribute, sell, or lease any part of the Site or its content without our prior written consent.

SubmissionsBy submitting any content to the Site, including but not limited to feedback, suggestions, or other information, you grant us a non-exclusive, worldwide, royalty-free, perpetual, and irrevocable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any media. 6.2. ResponsibilityYou are solely responsible for any content you submit to the Site. You agree that your content will not infringe upon the rights of any third party or violate any applicable law.

 

7. Disclaimers 7.1. No WarrantyThe Site is provided on an “as-is” and “as available” basis. We make no warranties, express or implied, regarding the operation or availability of the Site, or the information, content, materials, or products included on the Site. 7.2. Limitation of LiabilityTo the fullest extent permitted by law, OnTrack Workspace shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Site; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from the Site; (d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Site by any third party; or (e) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Site.

9. TerminationWe reserve the right to terminate or suspend your access to the Site, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Site will immediately cease.

 

10. Governing LawThese Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in England and Wales to resolve any dispute arising out of or relating to these Terms or the Site.

 

11. Miscellaneous 11.1. Entire AgreementThese Terms constitute the entire agreement between you and OnTrack Workspace regarding your use of the Site and supersede any prior agreements between you and OnTrack Workspace.

 

11.2. SeverabilityIf any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. 11.3. WaiverNo waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and OnTrack Workspace’s failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
